Acceptable Use Policy

This Acceptable Use Policy explains how DataPacket services may and may not be used. It helps protect our customers, our network, and the reliability and security of the services we provide.

This Acceptable Use Policy (“AUP”) governs the use of all services provided by Data Packet Networks LLC (“DataPacket,” “we,” “our,” or “us”), including web hosting, reseller hosting, VPS hosting, dedicated servers, domain services, and related network services. By using our services, you agree to comply with this policy.

1. Purpose

This policy is intended to protect the reliability, security, and reputation of our network while ensuring fair access to resources for all customers. Customers are responsible for all content, data, software, and activity occurring under their account.

2. Illegal Activities

Our services may not be used for any activity that violates applicable local, state, federal, or international laws.

  • Fraud, identity theft, credit card fraud, or money laundering
  • Unauthorized access to computers, accounts, systems, or networks
  • Distribution of malware, ransomware, viruses, or other malicious software
  • Child exploitation material or other unlawful exploitative content
  • Terrorist content, support, recruitment, or financing
  • Copyright or trademark infringement
  • Sale or distribution of illegal goods or services
  • Services intended primarily to facilitate criminal activity

3. Network Abuse

Customers may not engage in activities that negatively affect our network, other customers, or third-party systems.

  • Distributed denial-of-service or denial-of-service attacks
  • Reflection, amplification, packet flooding, or routing attacks
  • Unauthorized network, port, or vulnerability scanning
  • IP spoofing, ARP spoofing, or DNS poisoning
  • Attempts to bypass or defeat network security measures

Running security tools against systems you own or are authorized to test is permitted, provided the activity does not disrupt our network or other users.

4. Email Abuse

Our services may not be used to send unsolicited, deceptive, or abusive email.

  • Spam or bulk unsolicited commercial email
  • Email harvesting or use of purchased mailing lists
  • Open mail relays or email bombing
  • Phishing, forged email headers, or deceptive sender information
  • Spamvertised websites or snowshoe spam
  • Services intended primarily to send unsolicited email

Customers are responsible for securing email accounts and promptly addressing compromised accounts or scripts.

5. Malware and Malicious Content

Customers may not host, distribute, or intentionally execute software designed to harm others, steal information, obtain unauthorized access, or conceal malicious activity.

  • Viruses, worms, Trojans, ransomware, or credential stealers
  • Remote access Trojans, botnet software, web shells, or backdoors
  • Cryptocurrency miners installed or operated without authorization
  • Tools or files primarily intended to compromise third-party systems

Security researchers should contact us before conducting testing that could affect DataPacket infrastructure or other customers.

6. Resource Abuse

Customers may not intentionally consume resources in a way that harms system stability or prevents other customers from receiving reliable service.

  • Infinite loops, runaway processes, or fork bombs
  • Cryptocurrency mining on shared hosting services
  • Excessive disk input/output or database abuse
  • Continuous CPU-intensive workloads unrelated to normal website operation
  • Intentional attempts to exhaust memory, storage, processes, or network capacity

Temporary resource increases caused by legitimate website traffic are generally acceptable.

7. Hosting Content

Customers are responsible for all content hosted through their services.

  • Child exploitation material
  • Malware, phishing websites, or fraudulent websites
  • Scam websites or counterfeit goods
  • Illegal gambling where prohibited by applicable law
  • Content primarily intended to facilitate criminal activity

Adult content is permitted when it is lawful in the applicable jurisdiction and does not violate any other provision of this policy.

8. Abuse of Shared Hosting

Shared hosting is intended primarily for hosting websites and related applications. It may not be used as:

  • A file-storage service unrelated to hosted websites
  • A backup repository for unrelated systems
  • A public file-distribution network
  • A large-scale video-streaming platform
  • A cryptocurrency-mining platform
  • A high-volume proxy or VPN service

9. VPS and Dedicated Servers

VPS and dedicated server customers have greater administrative control but remain responsible for all activity originating from their services.

  • Maintain reasonable server and account security
  • Keep operating systems and software reasonably updated
  • Respond promptly to abuse reports and security incidents
  • Remove compromised or malicious software
  • Prevent systems from participating in attacks against third parties

Failure to secure a server does not exempt the customer from responsibility.

10. Security

Customers should take reasonable steps to protect their services and accounts.

  • Use strong, unique passwords
  • Enable multi-factor authentication where available
  • Keep websites, applications, plugins, and operating systems updated
  • Remove vulnerable or unsupported software promptly
  • Monitor services for unauthorized access or unusual activity

Compromised accounts or services may be temporarily restricted to protect our network, our customers, and third parties.

11. Abuse Reports

Customers must respond to abuse notifications within a reasonable timeframe. Failure to respond may result in temporary suspension until the issue has been resolved. Repeated or serious abuse may result in permanent termination.

12. Fair Use

While we strive to provide generous resources, customers may not intentionally use services in a way that materially degrades service for others. If unusual usage affects platform stability, we may require the workload to be optimized, modified, or moved to a more appropriate service.

13. Enforcement

Violations of this policy may result in one or more actions depending on the nature, severity, and history of the violation.

  • A warning or request for corrective action
  • Temporary service suspension
  • Network filtering or service restrictions
  • Removal or disabling of offending content
  • Permanent termination of services
  • Cooperation with law enforcement when legally required

Immediate action may be taken when necessary to protect our network, customers, or third parties from active harm.

14. Reporting Abuse

To report abuse involving DataPacket services or network resources, please use our online contact form. Include as much supporting information as possible, including timestamps, IP addresses, URLs, log excerpts, email headers, and other relevant evidence.

15. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Continued use of our services after an updated policy becomes effective constitutes acceptance of the revised policy.
